Terms and Conditions

Triggercontrol Carl Ahrens ("the organizer") offers shooting events for everyone, education and training for hunters, sportsmen, as well as authorized security and guard personnel or authorized persons. By booking an event or training (»Event«), you accept these General Terms and Conditions. An event can only be carried out if you accept by signature these terms and conditions and the GTC of the shooting range before the start of the event.

1 Scope of application
The terms and conditions regulate the organization of events by Triggercontrol Carl Ahrens.
2 Contract conclusion
As soon as you have decided to participate in an event, your written or oral commitment is binding. The booking completed is only with written confirmation by the organizer.
The booking is made for the actual number of persons; The participation in the event is not bound to one person and therefore transferable. The age regulation (point 7 of these terms and conditions) must be observed.
3 prices
The price for the event will be agreed in advance, confirmed by the organizer and is binding. Payment of the event takes place by prepayment / transfer. Possibly extras during the event must be paid directly cash in Euro, no EC or credit cards are accepted.
4 Cancellation
The booking can be cancelled at any time. The declaration of withdrawal must be addressed in writing to info@triggercontrol.de and is only effective after confirmation by the organizer. The following costs apply:
- Up to 14 days before the start of the event: free of charge
- Up to 8 days before the start of the event: 25% of the total price
- Up to 2 days before the start of the event: 60% of the total price
- Up to 1 day before the start of the event: 75% of the total price
- In case of cancellation on the day of the event or non-entry: 100% of the total price
In principle, the booking person is also jointly and severally liable for group events. The booked event is not personal. If a substitute is found in the event that the event is held as planned, the remaining is free of charge for the booker. In this case, the substitute person enters the rights and obligations of the contract.
5 Late arrival, premature termination
The event takes place at the previously agreed upon times (start and end). If the customer arrives late on the site, he has no right to add the missing time to the event. If, in the remaining time, the booked program can not be carried out completely, the complete and agreed price must still be paid. If the remaining time is less than 45 minutes, the event can not be carried out in principle or even in a shortened version. The complete and agreed price has to be paid.
If the customer terminates the event prematurely at his own request, there is no claim to a pro rata or complete reimbursement of the total price.
6 Alcohol, drugs and psychologically or physically changing medications
Participation in the event is only possible if the consciousness is clearly discernible. It is not possible to participate under the influence of alcohol, drugs or in the case of disturbed consciousness due to medication. In case of non-observation, the person concerned will be excluded from the event, the total price shall be paid in full.
7 Minimum age
Large caliber shooting is only possible for adults (18 years and older). Your passport / ID-card must be brought to the event. With the booking the customer declares that he as well as all participants are over 18 years old and legally competent. If a minor or legally incompetent person book an event under deception, it does not take place. Despite the refusal, the event price is to be paid according to the regulations mentioned under item 4.
8 Termination
The organizer reserves the right to exclude participants from the event. Reasons for this may include e.g. be:
- Person is under the influence of drugs, alcohol or in  the case of disturbed consciousness due to medication.
- The person has been forbidden to handle weapons by law.
- Failure to observe the generally accepted safety rules
- Disregard of the shooting rules.
- Disregard of the instructions of the supervisory staff
The total price is nevertheless to be paid.
The organizer reserves the right to cancel the event for reasons of force majeure, illness or technical problems. In this case, there is no obligation to pay the total cost. Advance paid events will be reimbursed by the Organizer unless a substitute date acceptable to the customer can be offered. Reimbursement of travel costs, hotel and / or catering costs is excluded.
9 Disclaimer
Participation is always at your own risk. The liability of the organizer or the shooting-range operator for damage of any kind for any legal reason, is limited to the cases in which the organizer or the shooting-range company operator is guilty of gross negligence.
10 Data protection and transmission of personal data
The participant agrees to the storage of his / her personal data such as name, first name, date of birth and address. At the same time, the participant agrees to the transfer of the above-mentioned personal data to the authorities responsible for exercising the tasks under international law as well as to the police or other law enforcement authorities upon their request. In addition, the participant agrees to the transmission of the abovementioned personal data to the operators of the respective shooting sites, if this is not the organizer himself, as well as to the insurer of the organizer (s), if necessary for the performance of the duties of the operator of the shooting center and the insurer is. Storage and transmission of the personal data takes place according to the data protection legislation. The participant is entitled to demand at any time information about the personal data stored there as well as to demand, blocking or deletion according to the data protection law.
11 Picture and recording rights
The organizer reserves the right to create photo and film recordings for advertising and information purposes during the event. If a participant disagrees, he / she must expressly inform the organizer. You can only take your own photo and film recordings of the participants if all participants in the event allow this to be closed.
12 Effectiveness
Should a clause of these General Terms and Conditions be ineffective, the statutory provisions shall take their place. The effectiveness of the other clauses remains unaffected.
13 Court of jurisdiction
Michelstadt, which is assigned to the seat of the organizer, or the Landgericht Darmstadt shall be agreed as the court of jurisdiction.

Allgemeine Geschäftsbedingungen

Triggercontrol Carl Ahrens (»der Veranstalter«) bietet Schießveranstaltungen für Jedermann und Aus- und Weiterbildungen für Jäger, Sportschützen sowie berechtigtes Sicherheits- und Wachpersonal bzw. berechtigte Personen an. Mit der Buchung einer Veranstaltung oder einer Ausbildung (»Veranstaltung«) erkennen Sie diese AGB an. Eine Veranstaltung kann nur durchgeführt werden, wenn Sie diese AGB und die AGB der jeweiligen Schießanlage vor Beginn der Veranstaltung per Unterschrift akzeptieren.

1 Geltungsbereich
Die AGB regeln die Durchführung von Veranstaltungen durch Triggercontrol Carl Ahrens.
2 Vertragsabschluss
Sobald Sie sich zur Teilnahme an einer Veranstaltung ausdrücklich entschieden haben, ist Ihre schriftliche oder mündliche Zusage bindend. Erst mit schriftlicher Bestätigung durch den Veranstalter ist die Buchung abgeschlossen.
Die Buchung erfolgt für die jeweilige Anzahl an Personen; die Teilnahme an der Veranstaltung ist nicht personengebunden und daher übertragbar. Die Altersregelung (Punkt 7 dieser AGB) ist hierbei zu beachten.
3 Preise
Der Preis für die Veranstaltung oder den Gutschein wird vorher schriftlich vereinbart, vom Veranstalter bestätigt und ist bindend. Die Bezahlung der Veranstaltung erfolgt per Vorkasse / Überweisung. Eventuell während der Veranstaltung zugebuchte Extras müssen direkt bar in Euro bezahlt werden, es werden keine EC- oder Kreditkarten akzeptiert.
4 Rücktritt
Die Buchung kann jederzeit zurückgenommen werden. Die Rücktrittserklärung muss schriftlich an info@triggercontrol.de gerichtet werden und ist nur nach Bestätigung des Veranstalters wirksam. Folgende Kosten fallen an bei Rücktritt:
– Bis 14 Tage vor Veranstaltungsbeginn: kostenlos
– Bis 8 Tage vor Veranstaltungsbeginn: 25 % des Gesamtpreises
– Bis 2 Tage vor Veranstaltungsbeginn: 60 % des Gesamtpreises
– Bis 1 Tag vor Veranstaltungsbeginn: 75 % des Gesamtpreises
– Bei Rücktritt am Veranstaltungstag oder Nichtantritt: 100 % des Gesamtpreises
Grundsätzlich haftet die buchende Person auch bei Gruppenveranstaltungen als Gesamtschuldner.
Die gebuchte Veranstaltung ist nicht personengebunden. Wenn bei Verhinderung Ersatz gefunden wird sodass die Veranstaltung wie geplant stattfinden kann, bleibt das Fernbleiben für den Bucher kostenlos. In diesem Fall tritt die Ersatzperson in die Rechte und Pflichten des Vertrags ein.
5 Verspätetes Eintreffen, Vorzeitiger Abbruch
Die Veranstaltung findet zu den vorher fest vereinbarten Zeiten (Beginn und Ende) statt. Trifft der Kunde verspätet vor Ort ein, hat er kein Recht, die fehlende Zeit hinten an die Veranstaltung anzuhängen. Sollten in der verbliebenen Zeit das gebuchte Programm nicht ganz durchgeführt werden können, muss dennoch der komplette und vereinbarte Preis gezahlt werden. Sollte die verbleibende Restzeit weniger als 45 Minuten betragen kann die Veranstaltung grundsätzlich und auch verkürzt nicht mehr durchgeführt werden, der komplette und vereinbarte Preis ist zu bezahlen. 
Beendet der Kunde die Veranstaltung auf eigenen Wunsch vorzeitig, besteht kein Anspruch auf anteilige oder komplette Erstattung des Gesamtpreises.
6 Alkohol, Drogen und psychisch bzw. physisch verändernde Medikamente
Die Teilnahme an der Veranstaltung ist nur bei sichtbar klarem Bewusstseinszustand möglich. Die Teilnahme unter Drogen- Alkohol- oder bewusstseinsstörenden Medikamenteneinfluss ist nicht möglich, Es gilt bei Umgang mit Schußwaffen die 0,0 promille Regel. Bei Nichtbeachten wird die betreffende Person aus der Veranstaltung ausgeschlossen, der Gesamtpreises ist komplett zu entrichten.
7 Mindestalter
Großkaliberschießen ist nur für Erwachsene (ab 18 Jahre) möglich. Ihr Personalausweis/Reisepass ist zu der Veranstaltung mitzubringen. Mit der Buchung erklärt der Kunde, dass er sowie alle Teilnehmer über 18 Jahre alt und voll geschäftsfähig sind. Sollte eine minderjährige oder nicht geschäftsfähige Person unter Täuschung eine Veranstaltung buchen, findet diese nicht statt. Der Veranstaltungspreis ist trotz Versagung entsprechend der unter Punkt 4 genannten Regelungen zu entrichten. 

8 Kündigung
Der Veranstalter behält sich das Recht vor, Teilnehmer von der Veranstaltung auszuschließen. Gründe hierfür können z.B. sein:
– Person steht unter Drogen-, Alkohol- oder Medikamenteneinfluss oder hat geistige Einschränkungen
- Der Person wurde der Umgang mit Waffen gerichtlich untersagt
– Nichtbeachten der allgemein geltenden Sicherheitsregeln
– Nichtbeachten der Schießstandregeln
– Nichtbeachten der Anweisungen des Aufsichtspersonals
Der Gesamtpreis ist dennoch zu bezahlen.
Der Veranstalter behält sich das Recht vor, die Veranstaltung aus Gründen höherer Gewalt, Krankheit oder technischen Problemen auch kurzfristig abzusagen. In diesem Fall entfällt die Pflicht, den Gesamtpreis zu zahlen. Im Voraus bezahlte Veranstaltungen werden bei Absage durch den Veranstalter aus o.a. Gründen erstattet, sofern kein für den Kunden akzeptabler Ersatztermin angeboten werden kann. Eine Erstattung von Reise- bzw. Anfahrtskosten, Hotel- und/oder Verpflegungskosten ist ausgeschlossen.
9 Haftungsausschluss
Die Teilnahme erfolgt stets auf eigene Gefahr. Die Haftung des Veranstalters bzw. des Schießstättenbetreibers für Schäden aller Art egal aus welchem Rechtsgrund sie entstehen mögen, ist auf die Fälle beschränkt, in denen dem Veranstalter bzw. dem Schießstättenbetreiber Vorsatz oder grobe Fahrlässigkeit zur Last fällt.
10 Datenschutz und Übermittlung personenbezogener Daten
Der Teilnehmer willigt in die Speicherung seiner personengebunden Daten wie Name, Vorname, Geburtsdatum und Adresse ein. Zugleich willigt der Teilnehmer in die Übermittlung der vorgenannten personengebundenen Daten an die mit der Wahrnehmung waffenrechtlicher Aufgaben betrauten Ordnungsbehörden sowie an die Polizei oder sonstige Strafverfolgungsbehörden auf deren Anforderung hin ein. Ferner willigt der Teilnehmer in die Übermittlung der vorgenannten personenbezogenen Daten an die Betreiber der jeweiligen Schiessstätten, sofern dies nicht die Veranstalterin selbst ist, sowie an Versicherer der Veranstalterin oder der Schiessstätten, sofern dies für die Wahrnehmung der Aufgaben des Betreibers der Schiessstätte sowie des Versicherers erforderlich ist, ein. Speicherung und Übermittlung der personenbezogenen Daten erfolgt nach Maßgabe der datenschutzrechtlichen Rechtsvorschriften. Der Teilnehmer ist berechtigt, jederzeit Auskunft über die ihn gespeicherten personenbezogenen Daten sowie deren Berichtigung, Sperrung oder Löschung nach Maßnahme der datenschutzrechtlichen Rechtsvorschriften zu verlangen. 
11 Bild- und Aufnahmerechte
Der Veranstalter behält sich das Recht vor, während der Veranstaltung Foto- und Filmaufnahmen zu Werbe- und Informationszwecken zu erstellen. Sollte ein Teilnehmer nicht einverstanden sein, so hat er die dem Veranstalter ausdrücklich mitzuteilen. Eigene Foto- und Filmaufnahmen der Teilnehmer können nur erfolgen wenn alle Teilnehmer der Veranstaltung dies geschlossen erlauben.
12 Wirksamkeit
Sollte eine Klausel dieser AGB unwirksam sein, tritt an ihre Stelle die gesetzliche Regelung. Die Wirksamkeit der übrigen Klauseln bleibt hiervon unberührt.
13 Gerichtsstand
Als Gerichtsstand wird das dem Sitz des Veranstalters zugeordnete Amtsgericht Michelstadt bzw. das Landgericht Darmstadt vereinbart.
